By accessing or using the PowerShellNerd website at powershellnerd.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms apply to all visitors, registered users, and contributors to the platform.
2. Description of Service
PowerShellNerd is a community-driven platform for sharing, discovering, and collaborating on PowerShell tools and scripts. The Service includes, but is not limited to:
- Browsing and discovering PowerShell tools and modules
- Submitting community tools linked to public GitHub repositories
- Requesting custom PowerShell scripts
- Participating in community features such as Q&A and bookmarks
- Following creators and rating tools within the community
- Subscribing to newsletters and notifications
3. User Accounts
To access certain features of the Service, you must create an account by authenticating through a supported third-party provider (GitHub or Google). By creating an account, you agree to:
- Provide accurate and complete information during the authentication process
- Maintain the security of your account credentials with the third-party provider
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or remain inactive for extended periods.
4. Tool Submissions and Content
When you submit a tool or contribute content to PowerShellNerd, you agree to the following:
- Ownership: You represent that you have the right to submit the tool and that it does not infringe on any third-party intellectual property rights.
- Public repositories: Community tool submissions must be linked to a public GitHub repository. The repository must remain publicly accessible for the tool listing to stay active.
- Accurate information: Tool descriptions, tags, and metadata must accurately represent the tool's functionality.
- No malicious code: You must not submit tools or scripts that contain malware, intentionally destructive code, or code designed to harvest user data without consent.
- License compliance: You must comply with the license terms of any third-party code included in your submissions.
PowerShellNerd reserves the right to remove, reject, or modify any submitted content that violates these Terms or that we determine to be inappropriate, misleading, or harmful.
5. Community Conduct
When participating in community features including Q&A, comments, and reviews, you agree to:
- Treat other members with respect and professionalism
- Not post spam, promotional content unrelated to PowerShell, or misleading information
- Not harass, intimidate, or discriminate against other users
- Not impersonate other users or misrepresent your identity
- Not attempt to manipulate ratings or download counts
Violations of community conduct standards may result in content removal, temporary suspension, or permanent account termination at our sole discretion.
6. Intellectual Property
The PowerShellNerd platform, including its design, logo, branding, and original content, is the property of PowerShellNerd and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our platform materials without prior written consent.
Tools and scripts submitted by users remain the intellectual property of their respective authors. By submitting content to PowerShellNerd, you grant us a non-exclusive, royalty-free license to display, distribute, and promote your content within the Service. This license does not transfer ownership of your work.
Tools sourced from the PowerShell Gallery are displayed under their original licenses as published by their authors. PowerShellNerd does not claim ownership of PowerShell Gallery content.
7. Script Requests
The script request feature allows users to request custom PowerShell scripts. By using this feature:
- You understand that fulfillment of requests is not guaranteed
- Requested scripts are provided as-is without warranty of functionality or fitness for a particular purpose
- You are responsible for reviewing, testing, and validating any scripts before using them in production environments
- You must not request scripts intended for unauthorized access, data theft, or other illegal activities
8. Limitation of Liability
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
PowerShellNerd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or in connection with your use of the Service. This includes, without limitation, damages resulting from:
- The execution of scripts or tools obtained through the platform
- Unauthorized access to or alteration of your data
- Service interruptions, errors, or downtime
- Any third-party content or conduct on the platform
9. Third-Party Services
The Service integrates with third-party services including GitHub, Google, and the PowerShell Gallery. Your use of these third-party services is governed by their respective terms of service and privacy policies. PowerShellNerd is not responsible for the availability, accuracy, or practices of third-party services.
10. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.
You may delete your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Submitted tools and content may be retained or removed at our discretion.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, features, or legal requirements. We will notify users of material changes by posting a notice on the Service or by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.
